By downloading, installing, or using the FitgenZ AI application ("App") or accessing fitgenz.live ("Website"), you ("User" or "Data Principal") agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy.

If you do not agree to these Terms, do not use FitgenZ.

These Terms constitute a legally binding agreement between you and FitgenZ ("Company," "we," "us," "our"), governed by the laws of India.

You must be at least 13 years old to use FitgenZ.

Users aged 13 to 17 must have verified parental or guardian consent. By using FitgenZ, you represent that you have obtained such consent.

Users under 13 are strictly prohibited from using FitgenZ. If we discover a user is under 13, we will immediately delete their account and data.

You must have the legal capacity to enter into a binding agreement under the laws of India or your jurisdiction.

You must provide accurate, current, and complete information when creating an account.

You are responsible for maintaining the confidentiality of your account credentials.

You are responsible for all activities that occur under your account.

You must notify us immediately at support@fitgenz.live if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in prohibited conduct.

FitgenZ provides the following services:

• ▹ Food scanning and nutritional analysis using AI
• ▹ Workout planning and exercise logging
• ▹ Health Score calculation and tracking
• ▹ AI coaching via Coach Riya
• ▹ Social accountability features (FitgenZ Duo, Trainer Dashboard, Group Challenges)
• ▹ Gym leaderboard and community features
• ▹ Gamification features (badges, tiers, shareable cards)
• ▹ Daily nutrition education cards
• ▹ Progress photo documentation

Services may be modified, suspended, or discontinued at any time with reasonable notice to users.

All content, features, and information provided by FitgenZ - including AI coach responses, nutritional estimates, workout plans, health scores, and skin analysis - are for EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

Nothing in FitgenZ constitutes medical advice, diagnosis, or treatment.

ALWAYS consult a qualified and registered healthcare professional before starting any new diet or eating plan, beginning any exercise programme, or making changes if you have any medical condition including diabetes, heart disease, eating disorders, pregnancy, or kidney disease.

Nutritional and calorie estimates provided by FitgenZ are APPROXIMATE. Individual results vary.

We are not liable for any health outcomes, injuries, or medical conditions that arise from use of FitgenZ.

Early Access. FitgenZ is currently in early access. Early access users receive full premium features at no charge for the duration of the early access period.

Premium Subscription. When premium subscriptions are introduced, billing is processed through Google Play Billing. We do not collect or store your payment card details. All payment disputes are handled through Google Play.

Subscription Terms. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Manage subscriptions through Google Play > Subscriptions > FitgenZ.

Refunds. Refund requests are subject to Google Play's refund policy. Contact support@fitgenz.live for assistance with refund requests.

Gym Partner Discounts. Gym-specific pricing requires verification of proximity to the partner gym at the time of subscription. Location data collected for verification is not permanently stored.

You agree NOT to:

• ▹ Use FitgenZ for any unlawful purpose or in violation of any Indian law or regulation
• ▹ Create fake accounts, impersonate others, or provide false information
• ▹ Attempt to reverse engineer, decompile, or extract the source code of the FitgenZ application
• ▹ Use automated tools, bots, or scripts to access or interact with FitgenZ
• ▹ Upload offensive, harmful, or inappropriate content including photos or messages
• ▹ Attempt to exploit vulnerabilities in FitgenZ's security systems
• ▹ Game or manipulate the leaderboard, points system, or streak system through artificial means
• ▹ Harass, bully, or threaten other users through Duo, Trainer, or Group Challenge features
• ▹ Share another user's private data without their consent
• ▹ Use FitgenZ to distribute spam, malware, or harmful content

Violations may result in immediate account suspension or termination without refund.

FitgenZ Content. All content in FitgenZ - including the application, logo, design, features, algorithms, badge artwork, tier system, character illustrations, and text - is owned by FitgenZ and protected by Indian copyright law and applicable international intellectual property laws.

User Content. Content you create - including meal photos, progress photos, and messages - remains yours. By uploading content to FitgenZ, you grant us a limited, non-exclusive, royalty-free licence to process and store your content to provide the Services, display your content to you and, where you have chosen to share it, to other users, and use anonymised, aggregated food scan data to improve our food identification model. We will never use your identifiable photos or content for advertising without your explicit consent.

Feedback. If you provide feedback, suggestions, or ideas about FitgenZ, you grant us the right to use this feedback without restriction or compensation.

Coach Riya. Responses from Coach Riya are generated by AI. They are not from a human coach or healthcare professional. Do not treat Coach Riya's responses as medical advice.

Food Identification. Nutritional estimates from food scanning are approximate. Accuracy depends on photo quality, portion visibility, and the AI model's knowledge. Always verify critical nutritional information with a registered dietitian.

Skin Analysis (Glow Arc). Skin analysis is for general informational purposes only. It is not a dermatological assessment. Consult a qualified dermatologist for skin health concerns.

AI Limitations. AI systems can make errors. We continuously work to improve accuracy but cannot guarantee that AI outputs are always correct. Your use of AI-generated content is at your own discretion.

For Gym Partners. Gyms partnering with FitgenZ agree to use FitgenZ solely to provide fitness accountability services to their members, not access, export, or use member data for any other purpose, maintain confidentiality of all member data, notify members that FitgenZ is used in their gym, comply with all applicable data protection laws, and immediately notify FitgenZ of any suspected data breach.

For Gym Members. When you join a gym's leaderboard, your display name and consistency points are visible to other members. Your trainer can view your workout and meal streaks if you accept a trainer connection. You can leave the gym leaderboard at any time from Settings > Social > Gym.

Gym Partner Data. Gym partner information (name, location, status) is stored by FitgenZ to enable verification and leaderboard features.

When you share workout cards, badge cards, or meal snap cards, cards contain your display name, fitness statistics, and FitgenZ branding. You are responsible for what you choose to share publicly. FitgenZ branding on shared cards may not be removed or obscured.

Progress photos shared via the selfie card feature are shared at your sole discretion. FitgenZ is not responsible for how shared content is received or used on third-party platforms.

Your use of FitgenZ is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By agreeing to these Terms, you also agree to our Privacy Policy and provide the consents described therein.

To the maximum extent permitted by applicable Indian law, FitgenZ and its officers, employees, and affiliates shall not be liable for:

• ▹ Any indirect, incidental, special, or consequential damages
• ▹ Loss of data or profits
• ▹ Personal injury or health outcomes arising from use of the Services
• ▹ Errors or inaccuracies in AI-generated content including nutritional estimates, workout recommendations, or skin analysis results
• ▹ Service interruptions or downtime

Our total liability to you for any claim shall not exceed the amount you paid to FitgenZ in the 3 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.

You agree to indemnify and hold harmless FitgenZ, Piyush Verma, and all employees and affiliates from any claims, losses, damages, and expenses (including legal fees) arising from your use of FitgenZ, your violation of these Terms, your violation of any third-party rights, or content you post or share through FitgenZ.

By You. You may delete your account at any time through Settings > Account > Delete Account. Deletion is permanent and all your data will be removed within 30 days.

By FitgenZ. We may suspend or terminate your account immediately and without prior notice if you violate these Terms, your account is inactive for 12 months, or we are required to do so by law.

Effect of Termination. Upon termination, your right to use FitgenZ ceases immediately. Provisions that should survive termination by their nature will survive, including medical disclaimer, intellectual property, and limitation of liability.

We may update these Terms from time to time. Material changes will be communicated through in-app notification at least 7 days before changes take effect and email notification to your registered email address.

Your continued use after the effective date of updated Terms constitutes acceptance of the new Terms.

If you do not agree to updated Terms, you must stop using FitgenZ and may delete your account.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or FitgenZ shall first be attempted to be resolved through good-faith negotiation by contacting piyush@fitgenz.live.

If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the competent courts in Prayagraj, Uttar Pradesh, India.

The Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020 may apply to your use of FitgenZ where applicable.

Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and FitgenZ regarding the Services.

Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment. You may not assign your rights under these Terms. We may assign our rights to a successor in the event of acquisition or merger.
